New Nintendo 3DS sometimes shuts off when I give it a nudge?

So apparently my New 3DS started shutting itself off yesterday. This started yesterday when I was replaying Awakening while I was waiting for Fates to come out in Europe, Portugal, to be more specific.

I was playing it while I was charging the battery, so maybe I gave it a wrong nudge when I removed the charger cable from the console as it instantly shut itself off when I removed it, this was the first time that that happened. After turning it back and still confused about what just happened I started noticing that whenever I moved the DS in a specific way or made some kind of sudden movement (or something like dropping it on my bed, opening the DS or closing it), the console will just shut down on its own, but only sometimes, it doesn't seem to happen all the time (yet), I've noticed that it's more frequent when I'm playing a game so maybe it's something related to the battery or an overheating issue?

I'm no longer under warranty by the way.
